No so happy couple: America's Top Model winner Eva Marcille has won full custody of her baby daughter as her restraining order battle with former beau Kevin McCall continues
However TMZ revealed the professional clotheshorse has now full custody of their baby daughter for the time being.

It comes after she took out a restraining order against McCall, 28, last month after he allegedly went on a rampage in their home.

She claims he kicked down doors and even tried to steal their daughter from her arms.
According to the terms of the order he is banned from coming within 100 yards of them.

Doting father: But McCall has been accused of going on a rampage at the former couple's home

And now Eva has full custody of their Marley Rae he is not allowed any visitation, with a further hearing into the matter scheduled for next month Eva's spokesperson said: 'It is unfortunate that life has thrown a curve Into Eva's life but as a responsible parent and adult she's taking steps to ensure the safety and well-being of their child and herself.'

Eva announced last August she was five months pregnant, and it was her former lover who was tasked with giving fans regular updates of her progress through social media.
