 At 6:15pm Jussie Smollett was release from Cook County Jail. His attorney says his conviction was unconstitutional and dreconian. I would agree however, I would like to know what grounds was the motion granted by the Appellate Court. Moreover, what was the deciding factors in the reversal of Judge James Linn's decision. As I said in the previous post; I do believe the case to be unconstitutional. However, I am curious what his lawyers have come up with for standing.  I didn't even finish my first report before receiving notice that Jussie had been released. The news is bitter sweet because if Jussie faces double jeopardy there goes another nail in the rights that we so take for granted.  Here we go here is the standard by which the Appellate Court granted the stay!   This man (Jussie Smollet) will stop at nothing to avoid his ephemeral prison sentence. These young people are not very knowledgeable when it comes to law. Especially the entitled ones. There is no legal basis for letting someone out of prison because they received external or internal threats. Sadly, enough his attorneys should know that there is no legal locus for this argument. He should have hired a more qualified lawyer that could look at the facts of his case and find a legal loophole, which these days is not that difficult to do.  Today, lawyers are not worth the gum on the bottom of my shoe unless it is a tort case. Criminal law, and criminal justice has been bought by the oligarchs in order to make money off of the private prison system introduced by Ron Reagan. Criminal defense lawyers don't know law and/or don't give a damn they will take your money and do nothing for you unless you have deep pockets. I said it in yesterday's blog and here we are. He has not taken responsibility and refuses to accept the consequences for his actions. From who!!!? Oh, I forgot probably himself.  He is scared that he might turn up dead; so does over half of the prison population. However, they don't get the same benefit! This is that two tier justice that I spoke of yesterday. For goodness sakes he will be in there by himself for 5 months. With good behavior he will be out quicker than that.  Let's review this case and you tell me should Jussie be in jail?  Now what is not reported is that immediately the people of Chicago didn't buy it. They had hard questions that to this day has not been directly addressed. However, for some reason I can not find those reports.
